Swift Currie partner Jeff Stinson will speak at the 2024 CLM Annual Conference on April 4, 2024, in San Francisco, CA. The topic of his roundtable discussion is "Medicare Beneficiary Settlement Strategies: Opioids, Evidence-Based Medicine & Medicare Set-Asides."
In 2023, the Centers for Medicare & Medicaid Services (CMS) removed the 72-month upper restriction on primary insurance payers requesting an amended review for submitted Medicare Set-Asides (MSAs). This policy change now provides primary insurance payers with a greater opportunity to settle future medical care for older claims that may have been previously considered unresolvable. As CMS continues to update its policy guidance, additional questions remain as to whether CMS will begin applying the Centers for Disease Control and Prevention’s (CDC) 2022 guidelines for opioid pain management. Will CMS continue to assume that injured claimants will require lifetime opioid medications for pain management, or will CMS agree to a more reasonable evidenced-based approach to opioid medication usage? Lastly, this roundtable will discuss the current status of non-submit evidenced-based MSAs and how such allocations may be a better alternative than a submitted allocation in certain settlement scenarios.
