Trucking and Transportation Litigation

Overview

The attorneys on Swift Currie’s trucking and transportation team have decades of experience effectively and efficiently representing the motor transportation industry. This includes representing nationally recognized long-haul motor carriers in addition to motor-carrier insurers and their policyholders. It also includes representation of container carriers and logging and forestry operations, both of which are essential to the economies of Georgia and the Southeast.

The members of the trucking and transportation team have completed more than 100 jury trials involving motor carriers and their drivers. These include many cases involving catastrophic injury and wrongful death.

The trucking and transportation team coordinates a highly sophisticated rapid response team that can have investigators and experts on-scene at any accident within Georgia, Alabama, north Florida and Tennessee, typically within hours of the accident occurring. This allows us to effectively manage the investigation, identify and interview witnesses almost immediately and to preserve all vital roadway and vehicle evidence.

The trucking and transportation team is steeped in its understanding of the Federal Motor Carrier Safety Regulations and how compliance with those regulations can affect the exposures presented to our clients.

Our team also understands the unique framework of coverage applicable to motor carriers both under state and federal law. This includes liability and cargo coverage and the applicability of Georgia’s Direct Action Statute.

We routinely present to our clients and the industry on relevant topics that are of interest to or affect their operations. Additionally, our team members regularly contribute to legal and trade publications, participate in educational programs and are active in the Trucking Industry Defense Association, Georgia Motor Truckers Association, Southeast Wood Producers Association and Defense Research Institute – Trucking Law Section.
