"Who Pays When an Employee Is Hurt Coming or Going From Work?"
Swift Currie attorney Caley Pitts authored an article for PropertyCasualty360 discussing “Who pays when an employee is hurt coming or going from work.”
In the article, Pitts explores the complexities surrounding reasonable ingress and egress when determining whether an employee is entitled to workers’ compensation benefits. Companies should be aware of the circumstances under which employees may qualify for workers’ compensation, as an influx of work-related injury claims can lead to increased insurance premiums.
Pitts presents a series of scenarios illustrating how legal precedents apply in various cases and when a situation may warrant a workers’ compensation claim. In Georgia, it is important to note that injuries sustained within 15 minutes before and 30 minutes after work are considered within the ingress and egress timeframes for workers’ compensation eligibility.
“Both employers and employees benefit from documenting how an employee’s accident or injury occurred as soon as possible, especially when and where it happened and why the employee was there at the time,” explains Pitts. “If there is a question of compensability related to reasonable ingress/egress, it would be beneficial for both parties to retain legal counsel.”
